Civil Litigation Questions
I was served with court papers. How many days do I have to respond?
Under the Rules of Court 2012, a defendant served with a Writ of Summons in Peninsular Malaysia generally has strictly 14 days from service to enter an appearance. Failure to do so allows the plaintiff to enter a Judgment in Default of Appearance against you.
Can I claim back money lent without a written contract?
While a written agreement is ideal, claims can still be pursued if you possess bank transfer slips, WhatsApp acknowledgments, or admissions of the debt. Consult our office with whatever evidence you have.
What is the monetary limit between Magistrate, Sessions, and High Court?
Generally, Magistrate Courts hear claims up to RM100,000; Sessions Courts hear civil claims up to RM1,000,000; and the High Court has unlimited jurisdiction for claims exceeding RM1,000,000.
